§1 Scope

(1) These GTC apply to all contracts for goods and services between the operator of the KBC shop, namely Kite District Thomas Beckmann, Friedrich-List-Allee 22, D-41844 Wegberg (hereinafter referred to as “Kite District”) and his customers.

(2) Contracts with Kite District can currently only be concluded in German.

(3) The General Terms and Conditions apply in the version valid at the time the contract was concluded.

§2 Conclusion of contract and contractual partner

(1) The offers in Kite District's online shop represent a non-binding invitation to the customer. The customer's order represents an offer to Kite District to conclude a purchase contract on the basis of these General Terms and Conditions. Kite District's confirmation of receipt of the order represents the order confirmation for the customer's purchase contract offer: The contract for the purchase contract is concluded upon receipt of this order confirmation.

(2) The contractual partner of the customer is Mr. Thomas Beckmann.

§3 cancellation policy

(You can print out this cancellation policy and take it with your order documents. This cancellation policy is also included with your delivery in paper form.)

(1) You can revoke your purchase contract offer within 14 days in writing (by letter, fax or email) or by returning the item without giving reasons. This period begins after you have received this cancellation policy in text form, but not before you have received the goods and not before we have fulfilled our information obligations in accordance with Article 246 Section 2 in conjunction with Section 1 Paragraphs 1 and 2 EGBGB and our obligations in accordance with § 312e paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Since this cancellation policy is attached to your shipment in paper form, the period begins with the receipt of the goods.

(2) The timely dispatch of a cancellation or the goods is sufficient to meet the cancellation deadline.

This address is already correctly specified on the return parcel slip enclosed with your shipment.


(5) Consequences of revocation

In the event of an effective revocation, the services received by both parties must be returned and any benefits (e.g. interest) surrendered.

If you cannot return the service received to us in whole or in part, or only in a deteriorated condition, you may have to pay us compensation for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to their inspection - as you would have been able to do in a retail shop.

In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as if it were your property and refraining from anything that would impair its value.

(6) Items that can be shipped by parcel are to be returned at our risk. Please send the goods back to us as an insured package using the return package slip enclosed with your shipment. If possible, please use the original packaging and all packaging components or, if necessary, use protective outer packaging.

(7) You have to bear the costs of the return if the delivered goods correspond to the ordered ones and if
a) the price of the item to be returned does not exceed EUR 40
or
b) if you have not yet provided the consideration (i.e. the payment or a contractually agreed partial payment) at the time of the revocation if the price of the item is higher than EUR 40.

If you have to bear the costs of the return, we will deduct the costs for the return (within Germany this is EUR 5.50) from your refund amount, otherwise the return is free of charge for you.

(8) Items that cannot be shipped by parcel will be picked up from you.

(9) Obligations to reimburse payments must be fulfilled within 30 days. Refunds are always made using the original method of payment. The period begins for you with the dispatch of your declaration of revocation or the item, for us with their receipt.

§4 Prices and shipping costs

(1) The prices given in the Kite District online shop include the statutory sales tax of currently 19%, but not the shipping costs.

(2) The shipping costs are for standard shipping

  1. within Germany with a goods value of less than 50 euros a flat rate of 5 euros for shipping as an insured GLS package.
    Kite District will cover the shipping costs for goods with a value of EUR 50 or more.

  2. to EU countries with a goods value of less than 100 euros, a flat rate of 8 euros for shipping as an insured GLS package.
    Kite District will cover the shipping costs for goods with a value of 100 euros or more.

  3. to Switzerland with a goods value of less than 100 euros a flat rate of 15 euros for shipping as an insured GLS package.
    Kite District will cover the shipping costs for goods with a value of 100 euros or more.

(3) The shipping costs for premium shipping via FedEx, TNT or UPS must be negotiated separately, as we only offer this option in individual cases and on request.

§5 Terms of payment

(1) Payments are made using one of the payment methods offered in the shop. These are currently paypal and prepayment by bank transfer. Kite District reserves the right to specify the payment methods available for an order process.

§6 Terms of Delivery

(1) The delivery is made by shipment from the warehouse to the delivery address provided by the customer when ordering. The availability of the goods and the probable time of dispatch result from the order confirmation.

§7 Warranty

(1) The statutory warranty provisions apply.

§8 Retention of title, offsetting, right of retention

(1) The goods remain the property of Kite District until full payment has been made.

(2) The customer only has the right to offset if his counterclaims have been legally established, recognized by Kite District or are undisputed. The customer is only authorized to exercise a right of retention insofar as his counterclaim is based on the contractual relationship with Kite District.
