General Terms and Conditions (GTC) – KBC Shop

§1 Scope

(1) These General Terms and Conditions (GTC) apply to all contracts for goods and services between the operator of the website https://kbc-shop.com , namely KBC-Shop Joscha Arndt , Marienberg 7, 41844 Wegberg (hereinafter referred to as “KBC Shop”), and its customers.

(2) Contracts with the KBC Shop can only be concluded in German.

(3) The version of these General Terms and Conditions in effect at the time of the conclusion of the contract shall apply.

§2 Contract Conclusion and Technical Steps

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to the customer to place an order.

(2) The ordering process includes the following steps:

Select one or more products by clicking the "Add to Cart" button.
Accessing the shopping cart and selecting the payment method
Customer data entry
Summary and verification of all information
Binding order placement by clicking on "Buy now"

(3) By submitting the order, the customer makes a binding offer. The purchase contract is concluded upon receipt of the order confirmation by KBC Shop.

(4) The contract text is not permanently stored by KBC Shop. However, the customer can print or save the order details before submitting the order.

(5) Input errors can be corrected before submitting the order using the usual functions of the browser and the shop system.

§4 Right of withdrawal

(1) Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins upon receipt of the goods and the written notice of the right of withdrawal.

(2) To meet the deadline, it is sufficient to send the notice of cancellation or the goods in good time.

(6) The buyer shall bear the return shipping costs. Goods that cannot be sent by parcel post will be collected.

§5 Prices and Shipping Costs

(1) All prices in the online shop are in euros, including statutory VAT (currently 19%).

(2) Shipping costs:

EU: €14.99
Switzerland: €19.99

(3) Bulky items such as boards incur separate shipping charges. These will be displayed at checkout.

(4) Delivery times vary depending on the product and are indicated directly on the respective product page.

§6 Payment methods

(1) Payment is made using one of the payment methods offered in the shop. The following payment methods are currently available via Shopify Payments:

§7 Delivery

(1) Delivery shall be made to the delivery address specified by the customer.

(2) Availability and expected shipping date are indicated on the product page or in the order confirmation.

§8 Warranty

(1) The statutory warranty rights pursuant to Sections 434 et seq. of the German Civil Code (BGB) shall apply.

§9 Retention of Title

The delivered goods remain the property of KBC Shop until full payment has been received.

§10 Set-off / Right of Retention

(1) Set-off is only permitted with undisputed or legally established counterclaims.

(2) Rights of retention exist only if they are based on the same contractual relationship.

§11 Liability

(1) KBC Shop shall be fully liable for damages resulting from injury to life, body or health, as well as in cases of intent and gross negligence.

(2) In cases of simple negligence, KBC Shop shall only be liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability shall be limited to the foreseeable damages typical for this type of contract.

§12 Dispute Resolution
